What is temporary loaning of staff?

Temporary loaning of staff  refers to a situation where a borrowing public authority borrows staff from another public authority on a full-time or part-time basis for a specific period, normally for a maximum of six months.

The borrowing public authority usually compensates the lending public authority financially for the borrowed employee, who carries out work at the borrowing public authority within the scope of their duties.

Temporary loaning of staff is based on the public authorities having a cooperation agreement, and on voluntary participation.

temporary loaning of staff is a form of cooperation governed by the Government Agencies Ordinance (2017:515) and the Ordinance on the Preparedness of Public Authorities (2022:524).

Not on leave, a consultant or a temporary worker – nor a secondary employment

The borrowed employee is therefore not on leave for a fixed-term appointment at another public authority, nor is he or she a consultant or to be regarded as a temporary worker. Nor is it a matter of employment constituting a secondary employment.

The main principle for all types of staff loans is that they are based on voluntary participation and must take place within the framework of the employee’s duties.

How does it work at Lund University?

Temporary loaning of staff may be initiated based on the organisation’s temporary need (up to six months full-time) for a specific skill set. They may also be initiated following a request from another public authority.

General agreement with other public authorities

In order for the university’s departments to be able to lend or borrow staff from another public authority, Lund University, as a public authority, must have entered into a staff loan agreement with the relevant authority.

At LU, it is the Director of HR who signs and enters into staff loan agreements between the university and other public authorities. Staff organisations are informed.

At present, Lund University has agreements in place with the following public authorities:

Agreement with the employee concerned prior to a decision

The relevant manager within the department, with the support of the local HR function, makes the decision to lend or borrowing an employee. An agreement must be signed with the employee concerned.

Please note that the decision on temporary loaning of staff must be registered, regardless of whether it is you as the manager who has made the decision on the  temporary loaning of staff, or the other public authority (i.e. you are borrowing a person). See the current Records Management Plan.

Information for employee organisations

All staff organisations are informed via a summary report. The supporting documentation should set out the background to the loaning of staff. Furthermore, a simplified risk and impact assessment from a health and safety perspective should be attached.

Following the loaning of staff, the manager concerned must carry out a follow-up. Comments on the procedures should be submitted via the local HR function.
